Terms of Service

Effective Date: January 1, 2023

1. Service Agreement

By engaging Apex Freight Logistics for LTL, expedited, or intermodal services, the Shipper agrees to these terms. All transit times are estimates unless explicitly contracted as "Guaranteed Expedited Delivery" in writing.

2. Freight Specifications & Liability

Shipper is responsible for accurate declaration of freight class, weight, and temperature requirements. Apex Freight Logistics' liability for cargo loss or damage is limited per the Carmack Amendment and our standard tariff rules, unless excess declared value coverage is purchased prior to dispatch.

3. Force Majeure

Apex Freight Logistics shall not be liable for delays or failures in performance resulting from acts beyond its reasonable control, including but not limited to acts of God, severe weather events disrupting mid-west transit corridors, labor strikes, or governmental actions.

4. Payment Terms

Unless otherwise negotiated, invoices are due Net 30 from the date of delivery. Late payments may be subject to a 1.5% monthly finance charge.
